This page covers both our Privacy Policy (Part I) and our Terms of Use (Part II). It applies to https://weisinsurance.com (the “Site”), operated by Weis Insurance Agency, LLC, an insurance agency located at 2101 S. Banker St., Effingham, IL 62401, and at 32 Zbinden Ln., Highland, IL 62249 (“Weis Insurance”, “we”, “us”, or “our”).

By using the Site, you agree to the Terms of Use in Part II and acknowledge the privacy practices described in Part I. If you do not agree, please do not use the Site.

The Short Version

  • We collect the information you send us through our quote, contact, and referral forms, plus standard analytics data about your visit.
  • We use it to quote and service insurance, and we share it with insurance carriers and the vendors who help us operate.
  • We do not sell your personal information.
  • Nothing on this Site binds coverage, changes a policy, or reports a claim. Those require speaking with a licensed member of our staff.

Part I — Privacy Policy

1. Who this policy covers

This policy describes how we handle information collected through the Site. As an insurance agency, we are a “financial institution” under the federal Gramm-Leach-Bliley Act (“GLBA”), and the nonpublic personal information you give us in connection with insurance is also governed by GLBA, its implementing regulations, and the Illinois Insurance Information and Privacy Protection Act (215 ILCS 5/1001 et seq.).

If you become our customer, you will receive a separate GLBA privacy notice describing our information-sharing practices and any right you have to opt out of certain sharing. That notice governs our handling of your customer information. This page does not replace it.

2. Information we collect

Information you give us. When you request a quote, contact us, refer a friend, subscribe to updates, or leave a review, we collect what you submit. Depending on the form and the type of insurance, this may include:

  • Name, mailing address, email address, and phone number
  • The type of insurance you are interested in, and the message or question you send
  • Date of birth, marital status, and household or dependent information
  • Property, vehicle, and business details, including addresses, values, VINs, payroll, and revenue
  • Driver’s license number and driving history
  • Current and prior insurance coverage, policy numbers, and loss or claims history
  • Occupation and employment information
  • Social Security number, when a carrier requires it to run a quote or issue a policy
  • Health, medical, and prescription information, if you are applying for life, health, or disability coverage

Some of this is sensitive. Please send it only through the channels we ask you to use, and never include a Social Security number, driver’s license number, account number, or health information in an ordinary email or in a general website contact form. If we need that information, we will ask you for it through a secure method or over the phone.

Information collected automatically. Like most websites, our service providers and we automatically collect technical information when you visit: IP address, browser type and version, operating system, device type, referring page, pages viewed, links clicked, time spent, and approximate location derived from IP address. We collect this through cookies and similar technologies. See Section 7.

Information from third parties. To prepare an accurate quote, insurance carriers and their vendors may obtain reports about you from consumer reporting agencies and industry databases — including motor vehicle records, prior-loss reports such as C.L.U.E., and credit-based insurance scores where state law permits. We may receive the results. Applications for life and health coverage may involve additional reports, including prescription history and, in some cases, a medical examination, all with your authorization. We may also receive your contact information from someone who refers you to us.

3. How we use information

  • Prepare quotes and shop your risk among our carriers
  • Submit applications and issue, bind, service, renew, and change policies
  • Assist you with billing questions and with reporting and following up on claims
  • Respond to your questions, requests, and referrals
  • Contact you about your policy, upcoming renewals, and coverage gaps
  • Send you agency news, newsletters, and marketing, where permitted and subject to your right to opt out
  • Operate, secure, troubleshoot, and improve the Site, and understand how it is used
  • Detect and prevent fraud, and verify identity
  • Comply with insurance laws and regulations, respond to regulators, and meet our record-retention obligations

4. How we share information

We share personal information only as described here:

  • Insurance carriers, wholesalers, and general agents. To quote, place, and service coverage, we send your information to the carriers and intermediaries we work with. Once they receive it, their own privacy practices apply.
  • Service providers. Companies that support our business under contract — our website platform and host, agency management and CRM systems, email and document delivery, e-signature, comparative rating tools, phone and text systems, analytics providers, IT support, and professional advisors. They may use the information only to perform services for us.
  • Claims-related parties. Adjusters, third-party administrators, appraisers, and similar parties involved in handling a claim.
  • Premium finance and payment processors. When you finance a premium or make a payment, to process the transaction.
  • Legal and regulatory recipients. When required or permitted by law: in response to subpoenas, court orders, or lawful requests; to insurance regulators and law enforcement; to establish or defend legal claims; to investigate suspected fraud; and to protect the rights, property, or safety of our clients, our staff, or the public.
  • Business transfers. If our agency is sold, merged, or reorganized, client information may transfer as part of that transaction, subject to applicable law.
  • With your direction. To anyone you ask us to share with — a mortgage company, lienholder, landlord, certificate holder, family member, attorney, or accountant.

We do not sell your personal information, and we do not rent, trade, or otherwise disclose our client lists for anyone else’s marketing purposes.

5. Your Illinois insurance privacy rights

Under the Illinois Insurance Information and Privacy Protection Act, you generally have the right to:

  • Ask whether we hold recorded personal information about you, and see or receive a copy of it, along with a description of who has received it in the preceding two years
  • Request that we correct, amend, or delete information you believe is inaccurate
  • Receive a written statement of reasons if an adverse underwriting decision is made, and the specific items of information that supported it

To exercise these rights, contact us in writing at the address below and include your name, address, and enough detail for us to locate your records. We may need to verify your identity before responding, and we will respond within the time the law requires (generally 30 business days). If we decline to correct information, you may file a statement of dispute that we will include with future disclosures.

Some information we hold — for example, records compiled in anticipation of litigation, or information a carrier holds rather than us — may be outside the scope of these rights. We will tell you if that applies.

6. Marketing, calls, and text messages

When you submit a quote request, contact form, or referral on this Site and provide a phone number, you consent to being contacted by us at that number about your inquiry, including by phone and by text message. Consent to marketing calls or texts is not a condition of purchasing insurance.

Message and data rates may apply. Reply STOP to any text message to opt out, or HELP for help. To stop marketing email, use the unsubscribe link in the message. To stop marketing calls, tell any member of our staff or contact us using the information below. We may still contact you about an active policy, a claim, a renewal, or a billing matter after you opt out of marketing.

Referring a friend. If you submit someone else’s contact information through our referral form, you confirm that you have their permission for us to contact them about insurance. Please do not submit anyone’s information without asking them first.

7. Cookies, analytics, and advertising

A cookie is a small file stored on your device that lets a site recognize your browser. We and our providers use cookies and similar technologies for necessary Site functions (security, form submission, remembering your cookie choices) and for analytics and marketing measurement.

Google Analytics. We use Google Analytics, which may include Advertising Features such as Demographics and Interest Reporting, to understand how visitors find and use the Site and to measure our marketing. You can opt out using the Google Analytics Opt-out Browser Add-on or adjust your Google ad settings. Google’s handling of this data is described in the Google Privacy Policy.

Bot Protection. Our forms are protected by Cloudflare Turnstile, a service that verifies you are a real person rather than an automated script. To do this, Turnstile processes a limited set of technical signals from your browser, including your IP address, TLS fingerprint, user-agent string, and the identifier of the site you are visiting. Cloudflare states that it cannot identify individuals from these signals, that Turnstile does not use cookies to collect or store information about you, and that it does not use this data for advertising or ad retargeting. Cloudflare processes these signals on our behalf to keep our forms secure, and also uses them to improve the accuracy of its own bot detection. Social and Advertising Pixels. If we run advertising, our pages may include tags from platforms such as Meta or Google that let us measure ad performance and show ads to past visitors.

Your choices. Most browsers let you block or delete cookies through their settings, and you can usually set your browser to warn you before accepting one. Blocking cookies may keep parts of the Site from working properly, including our forms. Because there is no common industry standard for honoring browser-based Do Not Track signals, the Site does not currently respond to them.

8. Health information

If you apply for life, health, disability, or long-term care coverage, we may handle health-related information. We use it only to obtain quotes and submit applications on your behalf, and we share it only with the carriers and intermediaries needed for that purpose, or as you authorize and as the law allows. Where we act on behalf of an employer’s health plan, additional protections under HIPAA may apply to that information.

9. Security

We maintain physical, electronic, and procedural safeguards designed to protect personal information from loss, misuse, and unauthorized access, and we limit access to staff who need it to do their jobs. Our Site uses encryption in transit for data submitted through our forms.

No website, email system, or method of electronic storage is completely secure, and we cannot guarantee absolute security. Unencrypted email in particular is not a secure channel. If you believe your interaction with us is no longer secure, please call us at 217-342-9777.

10. How long we keep information

We keep personal information as long as needed for the purposes described above and to meet the record-retention requirements that apply to licensed insurance producers, which generally require holding policy and transaction records for a period of years after coverage ends. We also keep records as needed to resolve disputes and enforce our agreements. When information is no longer needed, we dispose of it securely.

11. Children

The Site is intended for adults. We do not knowingly collect personal information from children under 13, and we do not direct the Site to children. Insurance transactions require an adult of legal contracting age. We may hold information about a minor when a parent or guardian provides it in connection with a policy — for example, a dependent on a health plan or a young driver on an auto policy. If you believe a child has submitted information to us directly, please contact us, and we will delete it.

12. Residents of other states

We serve clients primarily in Illinois. Some states give residents additional rights over their personal information, such as the right to access, correct, delete, or opt out of certain uses. Much of the information we hold is exempt from those laws because it is already regulated under GLBA. If you are a resident of such a state and would like to make a request, contact us using the information below, and we will let you know what rights apply and how we will handle it.

13. Other websites

The Site links to third-party websites, including carrier sites where you may pay a bill, view a policy, or report a claim, and our pages on Facebook and Google. We do not control those sites, and this policy does not apply to them. Review the privacy policy of any site you visit before providing information.

Part II — Terms of Use

14. Acceptance

By accessing or using the Site, you agree to these Terms of Use. We may update them at any time by posting a revised version with a new “last updated” date, and your continued use after that constitutes acceptance. If you disagree with a change, stop using the Site.

15. This Site does not create insurance coverage

This is the most important term on this page. Please read it carefully.

  • Nothing on this Site binds, issues, renews, changes, or reinstates insurance coverage. Submitting a form does not create coverage, and no coverage exists until a licensed insurance carrier accepts the risk and a licensed member of our staff confirms to you that coverage is bound.
  • Do not report a claim through this Site. The Site is not monitored continuously and is not a claim-reporting channel. To report a claim, call us at 217-342-9777 during business hours or contact your carrier directly using the number on your policy or ID card. Carriers generally offer 24-hour claim reporting.
  • Do not use this Site for time-sensitive requests. Requests to add a vehicle or driver, increase a limit, add a certificate holder, cancel a policy, or make any other change are not effective when submitted. They are effective only when we confirm them and the carrier processes them. If a request is urgent, call us.
  • Quotes are estimates. Any premium indication is based on the information provided, is subject to carrier underwriting, verification, and inspection, and may change or be declined. It is not an offer to insure.

16. Policy terms control

Descriptions of coverage on this Site are general summaries provided for convenience. They are not policy language. The actual terms, conditions, limits, deductibles, exclusions, and endorsements of the policy issued by the carrier determine what is and is not covered, and those terms control over anything stated here. Coverages, discounts, and products are not available in all states or from all carriers, and availability is subject to underwriting. Please read your policy.

17. Licensing and territory

Weis Insurance is a licensed insurance producer in the State of Illinois. We can offer and place insurance only in states and lines for which we and the relevant carrier are properly licensed. This Site is not an offer or solicitation to sell insurance in any jurisdiction where we are not licensed.

18. No professional advice

Content on the Site, including our blog, resources, articles, calculators, and checklists, is general information for educational purposes. It is not legal, tax, accounting, financial, or medical advice, and it is not a recommendation that any particular coverage is right for you. Your situation is specific to you. Consult us about insurance and consult a qualified professional for legal, tax, or financial matters.

Some content on the Site is supplied by third parties, including our website provider and carriers, and may not have been reviewed by us. We do not adopt or endorse third-party content, and we make no representation that any content is current, complete, or applicable to your circumstances. Insurance requirements and regulations change; content may be out of date when you read it.

19. Testimonials and reviews

Testimonials and reviews on the Site reflect the experiences of the individuals who gave them. They are not a guarantee, warranty, or prediction of the results any other client will get. Individual outcomes depend on coverage selected, carrier decisions, and the facts of each situation. Reviews may be republished from third-party platforms and may be edited for length. We do not pay for reviews.

20. Intellectual property

The Site and its contents — text, graphics, layout, logos, and compilations — are owned by us or our licensors and protected by copyright, trademark, and other laws. You may view, download, and print pages for your own personal, non-commercial use in connection with evaluating or managing insurance with us. You may not otherwise copy, reproduce, republish, frame, scrape, sell, or create derivative works from the Site without our written permission.

Carrier names and logos shown on the Site are the trademarks of their respective owners and appear to identify companies whose products we may offer. Their display does not imply that any carrier sponsors or endorses this Site.

21. Acceptable use

You agree not to:

  • Submit false, misleading, or fraudulent information, or impersonate anyone
  • Submit another person’s information without their permission
  • Attempt to gain unauthorized access to the Site, our systems, or any account
  • Introduce malware, or interfere with or disrupt the Site or its infrastructure
  • Use bots, scrapers, or automated means to access, harvest data from, or overload the Site
  • Use the Site to send spam, or for any unlawful, harassing, defamatory, or infringing purpose
  • Circumvent security features, including Cloudflare Turnstile

Insurance fraud, including material misrepresentation on an application, is a crime and may result in denial of coverage, rescission of a policy, and referral to authorities.

22. Your submissions

You are responsible for the accuracy and completeness of information you submit. An inaccurate or incomplete answer can affect your premium, and can give a carrier grounds to deny a claim or rescind a policy. If you post a public comment, question, or review, you grant us a non-exclusive, royalty-free license to use, reproduce, and display it in connection with our business, including on the Site and in marketing. Do not include confidential or sensitive personal information in anything you post publicly.

23. Availability

We do not guarantee that the Site will be available, uninterrupted, or error-free. We may modify, suspend, or discontinue any part of the Site at any time without notice, and we are not liable for any resulting unavailability.

24. Accessibility

We want the Site to be usable by everyone, and we work toward conformance with recognized accessibility standards. If you have trouble accessing any part of the Site, or need information in an alternative format, call us at 217-342-9777, and we will work with you to provide the information you need.

25. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY AS TO ACCURACY, RELIABILITY, OR UNINTERRUPTED ACCESS. Nothing in this section limits any obligation we owe you under Illinois insurance law or under a policy placed through us.

26. Indemnification

You agree to indemnify and hold harmless Weis Insurance Agency, LLC and its owners, employees, and agents from any claim, loss, or expense, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of the Site, or your submission of another person’s information without authorization.

27. Governing law and venue

These Terms and this policy are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of the Site or these Terms will be brought exclusively in the state or federal courts located in or serving Effingham County, Illinois, and you consent to the jurisdiction and venue of those courts. Nothing here waives any right you have to file a complaint with the Illinois Department of Insurance or to pursue a remedy provided under the Illinois Insurance Code.

28. General

If any provision is found unenforceable, the rest remains in effect and the unenforceable provision will be applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours in connection with a sale or reorganization of our business. These Terms, together with any separate agreement you sign with us, are the entire agreement between us regarding the Site. Section headings are for convenience only.
